Male employees participating in compulsory social insurance are entitled to 5–14 days of leave when their wife gives birth, depending on normal delivery, C-section, or multiple births. During this leave, they will receive 100% of the average salary used for social insurance contribution of the preceding 6 months.   1. Eligibility for maternity benefits

Male employees participating in compulsory social insurance whose wife gives birth, or whose wife is a surrogate mother giving birth.

  1. Leave duration for male employees (adjusted)
  • Before 2025: the period of leave entitlement must fall within 30 days from the child’s birth date.
  • From July 1, 2025, under Clause 2, 3 Article 53 and related provisions of the Social Insurance Law 2024, the last day of leave must fall within 60 days from the child’s birth date.

Specific leave entitlement:

🔹 05 working days: normal birth

🔹 07 working days: C-section delivery or baby born before 32 weeks

🔹 10 working days: twins; for triplets or more, 03 additional working days for every child from the third

🔹 14 working days: twins + surgery; for triplets or more + surgery, 03 additional days for every child from the third

  1. Lump-sum allowance at childbirth and reference level
  • Lump-sum allowance per child: equal to 2 times the reference level applicable in the month the female employee gives birth.
  • The current reference level is based on the statutory base salary before its abolishment. Under Decree 73/2024/NĐ-CP, the statutory base salary is VND 2.34 million/month.
