Vietnam improves tax management efficiency for cross-border e-commerce

The strong development of cross-border e-commerce has posed new challenges for tax administration worldwide, including Vietnam. To address these challenges, Vietnam has taken pioneering steps in developing a legal framework and implementing technical solutions to ensure fairness and efficiency in tax collection for cross-border e-commerce activities.

Challenges in Tax Management for Cross-Border E-commerce

  • Intangibility and Cross-Border Nature of Transactions: E-commerce transactions occur entirely in the digital environment, without the traditional form of physical transactions, making it difficult to determine the taxable entity, tax base, and place of supply.

  • Legal Framework Enhancement: Vietnam has issued the Law on Tax Administration No. 38/2019/QH14, which clearly defines the tax obligations of foreign service providers without a permanent establishment in Vietnam.
  • Establishment of an Electronic Portal for Foreign Suppliers: This portal enables foreign suppliers to quickly and conveniently fulfill their tax obligations, while also allowing tax authorities to more effectively monitor their activities.
  • Data Connectivity: Vietnam is actively connecting data with other countries and major e-commerce platforms to collect information on cross-border transactions, thereby enhancing tax management capabilities.
  • Technology Application: The application of information technology, particularly artificial intelligence and big data analytics, helps tax authorities more effectively detect and address tax evasion.

The implementation of these solutions has brought positive results:

  • Enhanced Transparency: Online tax declaration and payment increase transparency in the business operations of foreign service providers.

Future Challenges and Directions 

Despite these achievements, Vietnam still faces numerous challenges in managing cross-border e-commerce taxes, such as:

  • Complexity of New Business Models: The emergence of new business models like the sharing economy and cryptocurrency presents new tax management requirements.
  • Technological Race: Large technology enterprises continuously change their business models and utilize new technologies to avoid taxes.

To address these challenges, Vietnam needs to continue:

  • Legal Framework Enhancement: Updating and supplementing legal regulations to suit the development of e-commerce.
  • Strengthened International Cooperation: Participating in international forums to share experiences and learn best practices.
  • Investment in Technology: Enhancing technological capabilities to effectively manage cross-border e-commerce transactions.
