Do seasonal workers have to participate in compulsory social insurance (SI)?
This is a common question raised by many businesses, especially those operating in construction, restaurants, manufacturing, and short-term service sectors (such as security services, etc.).

Misunderstanding this issue is also one of the most frequent reasons leading to social insurance arrears, retrospective collection, and administrative penalties.

  1. What is a seasonal worker?

Under current Vietnamese labor laws, the concept of a “seasonal labor contract” no longer exists, unlike in the past.

Instead, labor contracts are classified solely based on their duration, including:

  • Indefinite-term labor contracts
  • Definite-term labor contracts

Therefore, the term “seasonal worker” is not a legal basis for determining whether compulsory social insurance participation is required.

  1. Are seasonal workers required to participate in compulsory social insurance?

✔️ Compulsory social insurance is required if:

The employee:

  • Signs a labor contract with a term of 01 month or longer
  • Regardless of whether the job is:
    • Short-term
    • Seasonal
    • Temporary or intermittent in nature

As long as the labor contract is from 01 month or more, participation in compulsory social insurance is mandatory.

❌ Compulsory social insurance is NOT required if:

  • The working period is less than 01 month
  • No labor contract is signed, but instead:
    • A job-based (service) contract
    • A collaboration contract
    • A per-task or per-job agreement

However, in these cases, personal income tax (PIT) must still be withheld and declared in accordance with tax regulations.

In addition, part-time employees who sign a labor contract and receive a monthly salary of VND 2,340,000 or more are also subject to compulsory social insurance participation as prescribed by law.

  1. Common mistakes made by businesses when hiring seasonal workers

Many businesses still mistakenly believe that:

  • “Seasonal workers are not required to participate in social insurance”
  • “If employees only work for a few months and are rehired later, social insurance is not required”

In practice, social insurance authorities assess compliance based on the actual working period and labor contracts.

If violations are detected, businesses may face:

  • Retrospective collection of social insurance contributions over multiple years
  • Administrative penalties
  • Late payment interest charges

  • Clearly identify the nature of the work
